Terms of Service
These Terms of Service govern your use of Tradeways, including its websites and mobile apps. They form a contract between you and Tradeways GmbH, c/o Domiix.ch GmbH, Baarerstrasse 107, 6300 Zug, Switzerland ("Tradeways", "we", "us", or "our"). You accept these Terms when you actively agree to them in an account or checkout flow; viewing a public page alone does not create a contract. If an account or subscription is for a business or other organisation, the person accepting confirms that they have authority to bind it. The English version is the source version. Translations are for convenience unless mandatory law gives a translation legal effect.
Effective date: 1 August 2026
1. Eligibility
You must be at least 18 years old and legally able to enter into this contract. You may use Tradeways only where the service is lawfully available to you. We can refuse, restrict, or end service where providing it would violate sanctions, export controls, or another legal restriction. You are responsible for complying with the laws that apply to your trading activity, records, and use of the service.
2. Your Account
You must provide accurate account information and keep it current, including an email address where you can receive contractual and service notices. You are responsible for safeguarding your credentials, passkeys, recovery methods, and devices, and for activity under your account. Tell us promptly at support@tradeways.app if you believe your account has been compromised. Accounts are personal unless the selected plan or a separate written agreement expressly permits organisation use. You must not sell, transfer, or share your account or give another person access to it. We may require you to verify your identity or control of an account before we act on a sensitive request.
3. The Service
Tradeways is trading-journal and analytics software. It lets you import or record trades and executions, document decisions, review performance, use analytical and AI-assisted features, and share selected information with mentors, communities, or the public. Tradeways also provides product documentation and Tradeways Macro, which organises, compares, and can interpret public central-bank information. You can use these information services without a paid subscription; they remain subject to the applicable parts of these Terms and the Risk Disclosure. Tradeways is not a broker, exchange, custodian, portfolio manager, or investment adviser. We do not execute or transmit orders, hold money or financial assets, manage portfolios, or provide personalised investment recommendations. The service does not replace independent financial, legal, accounting, or tax advice. The Risk Disclosure is part of these Terms. Features, integrations, limits, and supported data formats differ by plan and change as the service develops. We do not promise that every broker, instrument, import file, or third-party service will be supported or remain compatible.
4. Subscriptions And Payment
Paid plans bought directly from Tradeways are recurring subscriptions. The plan, billing interval, total price, currency, included taxes, and renewal terms shown at checkout form part of your contract. We charge your selected payment method when you subscribe. Your subscription starts when your payment succeeds and we activate access. It renews for another period of the selected length unless you cancel before the renewal date. By buying the subscription, you agree to automatic renewal and authorise us and our payment processor to charge the payment method you provide for the initial term and each renewal at the price then in effect. Section 4 explains how we notify you before a price change. You can cancel automatic renewal at any time in your account's billing settings or by contacting support@tradeways.app. Cancellation stops future renewal charges. Unless mandatory law requires a different result, your paid access continues until the end of the current paid period. Cancelling a subscription does not erase your account or data. Upgrades can take effect immediately with a prorated charge or credit. Downgrades and billing-interval changes normally take effect at the end of the current paid period. The billing interface shows the amount and effective date before you confirm a change. Cancelling does not by itself refund the current paid period. We do not give refunds or credits for a partly used period because you stopped using the service or changed your mind. This does not limit a mandatory right to a refund, price reduction, repeat performance, cancellation, or another remedy if the service is faulty or not supplied as promised. If a payment fails, we may retry it, ask you to update your payment method, restrict paid features, or suspend the subscription. You still owe charges validly incurred before cancellation or suspension. European Union And EEA Consumers If you are a consumer in the European Union or EEA, you have 14 days from the day the subscription contract is concluded to withdraw without giving a reason. The withdrawal right arises when the subscription contract is first concluded; it does not arise again when your subscription renews on the terms you already agreed to. We normally activate access as soon as payment succeeds. If we did not obtain your express request to start the service during the withdrawal period before activating access, we refund the full amount when you withdraw in time. If we did obtain that request and you then withdraw, you must pay the share of the price that corresponds to the service supplied before your notice, measured against the full billing period. We refund the rest. To withdraw, tell us before the 14-day period expires — for example by emailing support@tradeways.app or writing to the postal address in Section 18. You can use the model form at the end of these Terms, but you do not have to. We will reimburse payments due under the withdrawal right without undue delay and no later than 14 days after receiving your notice, using the original payment method unless you expressly agree otherwise. United Kingdom Consumers If you are a UK consumer, you have 14 days from the day the subscription contract is concluded to cancel without giving a reason; automatic renewal does not start a new cancellation period. We normally activate access as soon as payment succeeds. If we did not obtain your express request to start the service during that period before activating access, we refund the full amount when you cancel in time. If we did obtain that request, you must pay a proportionate share of the price for the service already supplied. We refund the balance within 14 days of your notice, using the original payment method unless you expressly agree otherwise. To cancel, use the contact routes and optional model form described above. Your mandatory rights under UK consumer law remain unaffected. Switzerland And Other Countries Swiss law does not provide a general cooling-off right for ordinary online purchases. If mandatory law in your country gives you a cancellation or renewal right, that right applies even if these Terms do not list it. Contact us if you believe a mandatory right applies to your purchase. Price Or Term Changes A new subscription price applies only after we tell you what will change and when. You may cancel before the new price takes effect.
5. Your Content And Data
"Your Content" means trade records, notes, images, messages, strategies, notebooks, profile information, and other material you submit to the service. You keep ownership of Your Content. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, format, transmit, and otherwise process Your Content, only as reasonably necessary to: • operate, secure, maintain, and improve the service; • follow your sharing choices; • provide support; • comply with law; and • enforce these Terms. This licence lasts while the content remains in the service and for the limited additional period needed for backups, legal obligations, disputes, and security records. You confirm that you have the rights and permissions needed to submit Your Content and to let us process and display it as you direct. You must not upload confidential information belonging to a broker, employer, client, or other person unless you are authorised to do so.
6. Sharing, Mentoring, And Communities
You control whether to share eligible information through account shares, mentor relationships, communities, messages, or public links. People you authorise can view, copy, or further share what they receive. Review your permissions and the audience before sharing. Removing a share stops future access through Tradeways but does not retrieve copies another person already made. Mentors, community owners, moderators, and other users act independently unless we expressly identify them as our representative. We are not a party to agreements between users, and we do not endorse or verify their qualifications, statements, performance, or services. The conduct and content rules in Section 9 apply to Your Content and your conduct. We may investigate reports and remove, restrict, preserve, or disclose content where reasonably necessary to enforce those rules, protect users or the service, or comply with law. We do not promise to monitor all content.
7. AI-Assisted Features
AI-assisted features analyse the journal entries, trading activity, strategies, or instructions you choose to provide. Outputs can be inaccurate, incomplete, outdated, or unsuitable for your circumstances, and they can miss relevant market, legal, tax, or personal information. You must review outputs independently, and you remain responsible for every trading or other decision. Do not submit third-party confidential information or personal data to an AI feature unless you have authority to do so. We use specialised providers to process AI requests, as described in the Privacy Notice.
8. Third-Party Services And Data
Tradeways works with services run by others, including brokers, data providers, authentication providers, and payment services. Their services and terms are separate from ours. When you connect or use them, you authorise us to receive or send data as needed. Third-party data can be delayed, incomplete, duplicated, misclassified, adjusted, or unavailable. Imports and calculations can differ from broker statements because of timezone, currency, fee, corporate-action, instrument, or formatting differences. Your broker, exchange, custodian, and official records remain authoritative for trading, tax, and account purposes.
9. Acceptable Use And Community Rules
Use The Service Lawfully Do not use Tradeways to commit, encourage, coordinate, or conceal unlawful activity. This includes fraud, theft, market manipulation, insider trading, sanctions evasion, money laundering, unlawful financial promotion, impersonation, harassment, threats, stalking, extortion, and the sale of illegal goods or services. Do not present a journal entry, performance result, simulated result, testimonial, or identity in a false or materially misleading way. Do not guarantee returns, fabricate trades, hide material losses, or use Tradeways to deceive another person about qualifications, results, risk, or compensation. Respect Other People Do not threaten, bully, harass, shame, or target people with hateful or degrading content. Do not coordinate abuse or publish personal information to intimidate, expose, or endanger someone. Do not impersonate another person or organisation or misrepresent an affiliation. Tradeways is for adults. Do not sexualise minors, solicit minors, or upload child sexual abuse material. Do not post or threaten to post intimate images without the depicted person's consent, including manipulated or AI-generated depictions. We may refer reports involving immediate danger or exploitation to the appropriate authorities. Respect Privacy And Confidentiality Do not upload or disclose personal data, private communications, broker credentials, account numbers, financial records, or confidential business information unless you have a lawful basis and the necessary permission. Redact information that other users do not need. Do not use shared access, communities, or public links to monitor a person secretly or to collect personal data for an unrelated purpose. Access only information that a user has intentionally shared with you. Respect Intellectual Property Post only content you created or are authorised to use. Do not infringe copyright, trademark, database, publicity, or other rights. Do not remove ownership notices or pass off another person's content or trading materials as your own. Protect The Service Do not introduce malware, probe or exploit vulnerabilities, bypass authentication or access controls, interfere with service availability, evade rate or usage limits, automate access without permission, or access another user's account or data. Do not scrape, copy, or extract the service or user data at unreasonable scale. Do not reverse engineer protected parts of the service except to the limited extent applicable law expressly allows. Report suspected vulnerabilities privately to support@tradeways.app. Do not expose a vulnerability publicly before we have had a reasonable opportunity to address it. No Spam Or Manipulation Do not send unsolicited promotions, repetitive messages, deceptive links, referral spam, or artificial engagement. Do not buy, sell, or automate accounts, reactions, membership, or reputation. Community owners and mentors may set additional rules that do not conflict with these Terms. Reporting And Enforcement Use the in-service report control where available. You can also send a report to support@tradeways.app. Identify the specific content or account, give its URL or other location, explain the concern, and include supporting information. Do not submit knowingly false, abusive, or duplicative reports. Special reporting instructions for illegal content, copyright concerns, and non-consensual intimate images are in the Platform Notice. Authorised community moderators or Tradeways may review reports and relevant account records and may: • warn a user; • reduce visibility; • remove content; • restrict a feature; • suspend or terminate an account or community; • preserve evidence; or • refer a matter to the authorities. We consider the nature, context, severity, frequency, intent, harm, and prior conduct. Tradeways personnel make final decisions to restrict content or accounts. We may act immediately where necessary to prevent harm, protect the service, or comply with law. We do not promise to monitor or pre-approve all content. If we do not act on one report, we do not waive these Terms. If we restrict your content or account, you may ask for review by replying to the notice or emailing support@tradeways.app. Identify the decision and explain why you believe it should change. This process does not limit a statutory complaint or appeal right.
10. Tradeways Intellectual Property
Tradeways and its licensors own the service, software, designs, documentation, trademarks, and other materials we provide, excluding Your Content. As long as you comply with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the service during your account or subscription term for its intended purpose. Feedback is voluntary. If you give us an idea or suggestion, you grant us a perpetual, worldwide, non-exclusive, royalty-free right to use it without restriction or payment. We do not have to use it.
11. Service Availability And Changes
We work to keep Tradeways available but do not guarantee uninterrupted or error-free operation. Maintenance, security work, third-party failures, connectivity problems, and events outside our reasonable control can interrupt the service. We may add, change, or remove features where reasonably necessary to improve the service, adapt it to a new technical environment or increased use, address security or legal requirements, or respond to third-party changes. A change will not add a charge during a prepaid term. If a change materially reduces your access to or use of a paid feature, we will give you reasonable advance notice in a durable form you can keep and tell you about any termination or refund right the law gives you. Where reasonably possible, we may instead let you keep using the prior version at no extra cost. We may discontinue the service, or end the contract without any breach by you, by giving reasonable notice. If we end a paid service before the end of a prepaid term for reasons other than your breach or a legal requirement, we will refund the prepaid fee for the period after termination.
12. Suspension And Termination
You may stop using Tradeways at any time and may cancel a paid subscription as described above. Deleting your account is separate from cancelling a subscription. The Privacy Notice explains what deletion means for your personal data and how to make a separate deletion request. We may restrict or suspend access where reasonably necessary to investigate suspected misuse, protect users or systems, prevent fraud, respond to non-payment, or comply with law. We may terminate an account for a material or repeated breach, unlawful use, or a serious security risk. Where appropriate, we will give notice and a reasonable opportunity to fix the issue. We may act immediately where delay would create material harm, legal exposure, or security risk. When the contract ends, your right to use the service ends. Provisions that by their nature should survive, including ownership, payment obligations, licences needed for retained records, liability, and dispute terms, remain in effect.
13. Warranties And Statutory Rights
We will provide the service with reasonable care and skill. Apart from the express commitments in these Terms and the rights that cannot legally be excluded, we provide the service on an "as available" basis. We do not promise that it will meet every purpose, produce profitable results, detect every error, or remain compatible with every third-party source. Nothing in these Terms excludes, restricts, or replaces a guarantee, warranty, remedy, or other right that mandatory consumer law gives you.
14. Liability
Nothing in these Terms limits liability that cannot legally be limited, including liability for intent or gross negligence, fraud, or death or personal injury where the applicable law prohibits limitation. If you are a consumer, our liability remains subject to the mandatory law that applies to you. Where a limitation is permitted, we are responsible for reasonably foreseeable direct loss caused by our breach of these Terms. We are not responsible to the extent a loss is caused by your trading decisions, inaccurate third-party data, unauthorised sharing by a recipient, or events outside our reasonable control. If you use Tradeways for a business or professional purpose, then, to the maximum extent permitted by law, we are not liable for lost profits, revenue, business opportunities, goodwill, anticipated savings, or indirect or consequential loss. Our total liability arising out of or relating to the service in any 12-month period is limited to the greater of CHF 100 and the fees you paid or owe for the service during the 12 months before the event giving rise to the claim. These limitations do not apply to fraud, intent, gross negligence, death or personal injury, or another liability that cannot legally be limited. If the Australian Consumer Law protects you, nothing in these Terms excludes a consumer guarantee, and a permitted limitation of liability applies only to the extent it is fair and reasonable. If you use Tradeways for a business or professional purpose, you must indemnify us against a third-party claim and the reasonable resulting costs to the extent caused by Your Content, your unlawful use of the service, or your material breach of these Terms. This indemnity does not apply to the extent the claim was caused by our breach, negligence, or wilful misconduct.
15. Changes To These Terms
We may update these Terms for new features, legal or security requirements, or reasonable business needs. The current version shows its effective date. A material change applies no earlier than the next renewal of a paid subscription, unless the law requires it sooner or it is needed to address an urgent security risk. We notify you through your account email or an in-service notice and ask for renewed acceptance where required. If you do not accept a material change, you may stop using the service and cancel renewal before it takes effect.
16. Governing Law And Disputes
Swiss law governs these Terms, excluding its conflict-of-law rules. If you are a consumer, this choice does not deprive you of mandatory protections under the law of your habitual residence. Please contact support@tradeways.app first so we can try to resolve a concern. If you are a consumer, you may bring a claim in any court available under mandatory law, and nothing here requires you to litigate only in Switzerland. If you use Tradeways as a business, the courts at the registered office of Tradeways GmbH in Zug, Switzerland, have exclusive jurisdiction.
17. General
If a court finds part of these Terms unenforceable, the rest continues in effect, and the affected provision applies to the maximum extent permitted by law. If we do not enforce a provision, we do not give up the right to enforce it later. You may not assign this contract without our consent. We may assign it as part of a merger, reorganisation, sale of the service, or transfer to an affiliate, provided this does not reduce your contractual or mandatory rights. These Terms, the Risk Disclosure, and any plan-specific terms shown at checkout form the contract for the service. The Privacy Notice and Cookie Notice explain how we handle data; they do not waive your contractual rights.
