This Risk Disclosure is provided by Tradeways GmbH (“Tradeways”, “we”, “us”, or “the Company”), the operator of the Tradeways platform. It applies to everyone who accesses or uses Tradeways, anywhere in the world. Please read it carefully before using the platform. By using Tradeways, you confirm that you have read, understood, and accepted this Risk Disclosure.

1. General Risk Warning
Trading and investing in financial instruments — including stocks, forex, futures, options, contracts for difference (CFDs), crypto-assets, and other leveraged or non-leveraged products — involves a high level of risk and is not suitable for everyone. The use of leverage can work both for and against you. You may lose part or all of your invested capital, and with some products you may lose more than your initial deposit. Never trade with money you cannot afford to lose, and never with funds you need for your living costs or essential obligations. The large majority of retail investor accounts lose money when trading leveraged products such as CFDs. You should carefully assess whether you understand how these products work and whether you can afford to take the high risk of losing your money. Past performance is not a reliable indicator of future results. Any historical figures shown in Tradeways — including profit and loss, win rates, returns, and other performance statistics — reflect past activity only and neither predict nor guarantee any future outcome.
2. Nature of the Service: Information and Education Only
Tradeways is a software platform for journaling, tracking, and analysing your own trading activity, and a platform through which independent third-party coaches and educators may offer educational and mentoring content. Tradeways is a technology and information service only. Tradeways does not execute or arrange trades, route or transmit orders, hold or manage client funds or assets, provide portfolio or asset management, give investment advice, or operate any trading-signal, copy-trading, or fund-management service. We are not a bank, broker, exchange, asset manager, payment service, or financial institution, and we do not connect you to any market or broker for the purpose of dealing. Tradeways, the people behind it, and the independent coaches on the platform actively trade their own accounts and may hold or take positions in the instruments they discuss — including instruments referenced in content, analytics, or trade ideas shared on the platform or elsewhere, such as on social media. Their interests may therefore differ from yours. Such trading is carried out in their own name and for their own account, may differ from anything shown on the platform, and is never a recommendation to you. All content, tools, analytics, statistics, calculators, and AI-generated insights provided through Tradeways are offered solely for general informational and educational purposes.
3. No Investment Advice and No Regulatory Authorisation
Nothing made available through Tradeways constitutes investment advice, a personal recommendation, financial, legal, tax, or accounting advice, or an offer or solicitation to buy, hold, or sell any financial instrument or to adopt any trading or investment strategy. No content on Tradeways takes into account your personal circumstances, financial situation, investment objectives, knowledge, experience, or risk tolerance. It is general in nature and distributed to a broad audience. Any decision you make is your own independent decision. The Company is not licensed, registered, or supervised as a bank, securities firm, portfolio manager, investment adviser, or financial-services provider in any jurisdiction, and holds no such authorisation. The Company does not provide regulated financial services within the meaning of the Swiss Financial Services Act (FinSA/FIDLEG), the German Banking Act (KWG) or Securities Institutions Act (WpIG), the EU MiFID II framework, or comparable laws.
4. Your Trading Data, Analytics, and AI Insights
Tradeways imports, calculates, and displays data based on the trades and information you or your connected sources provide. This data may contain errors, gaps, or inaccuracies — for example from broker imports, manual entry, delays, or mismatched instrument settings. You are responsible for verifying that your data is accurate and complete. Analytics, scores, statistics, and AI-generated insights are produced automatically and may be incomplete, inaccurate, or unsuitable for your purposes. They describe your past activity and must not be relied upon as a prediction of, or a recommendation for, future trading. We make no warranty as to the accuracy, completeness, timeliness, or fitness for any particular purpose of any information shown on the platform, except where such a warranty cannot be excluded under applicable law.
5. Third-Party Coaches and Educational Content
Tradeways may make available educational, mentoring, and other content created by independent third-party coaches and educators. This content is created, published, and maintained by those third parties on their own responsibility. Tradeways does not author, control, review for accuracy, verify, endorse, or adopt third-party content as its own. All opinions, statements, strategies, signals, and results expressed in such content are solely those of the respective coach or educator and do not represent the views of Tradeways. Coaches and educators are independent providers. They are not employees, agents, representatives, or partners of Tradeways, and they do not act under our authority or control. We do not guarantee the qualifications, integrity, or performance of any coach, and we are not a party to any agreement you may enter into with a coach. Like all content on the platform, third-party content is for educational purposes only and is not investment advice or a recommendation. To the maximum extent permitted by applicable law, we accept no liability for third-party content or for any decision you make in reliance on it. If you believe that any content is unlawful, infringing, or otherwise in breach of our terms, please report it to support@tradeways.app with the exact location (URL) and the reasons. We review such reports and take action where required by law.
6. Performance Claims and Testimonials
Any results, performance figures, or testimonials shown on or in connection with Tradeways — whether from us, from users, or from coaches — describe individual past experiences. They are not representative, not typical, and offer no assurance that you will achieve similar results. No one associated with Tradeways guarantees any profit, income, or specific outcome from trading or from using the platform or any educational content. Trading results depend on many factors outside our control, including your own decisions, your discipline, and market conditions. Be especially cautious of any promise of guaranteed, risk-free, or “get-rich” returns. Such claims are inconsistent with the realities of trading.
7. Your Responsibility and Eligibility
Before trading, carefully consider your investment objectives, level of experience, and risk tolerance, and make sure you understand the risks involved. We strongly recommend that you seek advice from an independent, licensed financial, legal, or tax adviser before making any financial decision. You trade and make decisions at your own risk and on your own responsibility. You are solely responsible for your trades, your results, and the use you make of any information on the platform. Tradeways is offered worldwide, but it is your responsibility to ensure that your use of the platform is lawful in your country of residence. The availability of Tradeways is not an offer or solicitation in any place where this would be unlawful, and you must comply with all laws and regulations that apply to you.
8. Limitation of Liability
You use Tradeways and all information provided through it at your own risk. Nothing in this Risk Disclosure limits or excludes any liability that cannot be limited or excluded under applicable law. In particular, we do not exclude or limit our liability for damage caused by intent or gross negligence, for injury to life, body, or health, or under any mandatory statutory liability. Subject to the paragraph above, and to the maximum extent permitted by applicable law: • We are liable for slight negligence only where we breach an essential contractual obligation (an obligation whose fulfilment is necessary to achieve the purpose of the contract and on which you may reasonably rely), and in that case our liability is limited to the foreseeable damage typical for this type of contract. • Any further liability for slight negligence is excluded. • We are not liable for trading losses, lost profits, or other financial losses resulting from your trading decisions, from your reliance on any content, analytics, or third-party content, or from errors, delays, or interruptions in the data or the service. These limitations also apply in favour of our bodies, employees, contractors, and other auxiliary persons. If you are a consumer, the mandatory consumer-protection rules of your country of residence remain unaffected (see “Governing Law” below).
9. Governing Law and Your Mandatory Consumer Rights
This Risk Disclosure and your use of Tradeways are governed by the substantive laws of Switzerland, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law does not deprive you of the protection granted to you by the mandatory provisions of the law of the country in which you have your habitual residence. For consumers in the European Union, this means that the mandatory consumer-protection rules of your home country continue to apply alongside Swiss law. If any provision of this Risk Disclosure is or becomes invalid, the validity of the remaining provisions is not affected.
